Modesto Police make arrest in robbery and shooting at We Donuts

Modesto Police on Wednesday arrested a suspect in a robbery and shooting at We Donuts on Scenic Drive and found evidence that connects him to at least two other armed robberies.

David Leon Smith, 35 of Modesto, was arrested on suspicion of robbery, attempted murder, discharging a firearm during the commission of a robbery, and being a felon in possession of a firearm and ammunition.

The robbery occurred just after 6:20 a.m. Tuesday. Police said the suspect entered the store wearing a back ski mask, pulled out a black handgun and demanded money.

At some point the suspect fired a gun and a female employee was hit. She was hospitalized and is expected to survive, authorities said.

During the course of their investigation, detectives identified the suspect as Smith. According to a press release, Smith matched the description of a suspect in an armed robbery at the 7-Eleven in the 3200 block of McHenry Avenue on Oct. 6. No injuries were reported during that incident.

Detectives on Wednesday located and arrested Smith, and recovered a firearm that is believed to have been used during both robberies.

“Other evidence located during his arrest not only connected David to the robberies MPD was investigating, but also a robbery reported in the City of Livermore on Oct. 9,” according to the press release. “That robbery is being investigated by the Livermore Police Department, and detectives are working with them to assist them in that investigation.”

Booking records show he is being held on $1.675 million bail.
