A Salida man has been charged with murder in the death of his uncle and faces other charges, including child abuse, because two young children were present at the time of the shooting and one was injured.

Mario Trevino Jr., 30, is accused of using a shotgun to kill Ernest Trevino, 39, at a home in the 2400 block of Glednale Avenue in southeast Modesto on March 25.

Mario Trevino was arrested during a traffic stop the following day when a Stanislaus County Sheriff’s Deputy found a loaded firearm in his vehicle. He was arrested on suspicion of being a felon in possession of a firearm.

Modesto Police continued to investigate the crime and a week later re-booked him on suspicion of murder.

Mario Trevino was also charged with shooting at an occupied building. According to the criminal complaint, four people, including a 3-year-old girl and a 4-year-old boy, were inside.

The third and fourth counts on the complaint are for causing those children to suffer under circumstances likely to produce great bodily injury or death and there is an enhancement on the count related to the 3-year-old girl for causing her injury.

Modesto Police Department spokeswoman Sharon Bear said she did not know how the girl was injured but did confirm her injuries were minor.

Finally, Mario Trevino was charged with being a felon in possession of a firearm and ammunition.

He faces enhancements for using a shotgun and premeditation.

According to the compliant, Mario Trevino has prior convictions of assault with a firearm and burglary.

Bear said the motive for the shooting remains under investigation.

Trevino is being held without bail. Anyone with information on the homicide is urged to contact Detective Joshua Grant at 209-342-9104 or Crime Stoppers at 209-521-4636.
