Trial set for Turlock man in fatal shooting of alleged intruder
A judge on Tuesday scheduled a trial to start Jan. 17 for a Turlock man accused of murder in the shooting death of a suspected intruder.
Robin Boyer, 61, is charged with murder in the death of 25-year-old Brandon Pacheco. Prosecutors say Boyer shot Pacheco in the back after catching Pacheco stealing from the defendant’s property in Turlock.
Kirk McAllister, Boyer’s attorney, has argued that his client thought he had fired the second shot above Pacheco, and his intent was only to scare Pacheco. Boyer remains in custody at the county jail.
The shooting occurred shortly before 8 a.m. July 23, 2013, at Boyer’s home on the rural property in the 1100 block of Dianne Drive in Turlock.
The trial is estimated to last three weeks. Stanislaus Superior Court Judge Ricardo Córdova scheduled Boyer to return to court June 15 for a pretrial hearing.
McAllister said asked for the June hearing, hoping a plea deal could be reached before trial. Deputy District Attorney John R. Mayne told the judge that there have not been any negotiations over a plea deal so far.
