Salida man gets prison for second DUI conviction

A 34-year-old Salida man has been sentenced to 16 months in prison for driving under the influence of alcohol on Highway 99 while still on probation for a previous DUI conviction.

Carlos Diermissen Jr. was driving with a .15 percent blood alcohol content, nearly twice the legal limit, when the California Highway Patrol pulled him over on Oct. 9, according to the Stanislaus County District Attorney’s Office.

The prosecutors said Diermissen was speeding and weaving on Highway 99 in Turlock when the CHP spotted him. He was arrested after failing several sobriety tests. Prosecutors charged Diermissen with felony DUI due to his 2012 DUI causing injury conviction.

On July 15, 2012, Diermissen was driving on Highway 99 in Turlock when he lost control of his car. The vehicle rolled over, and Diermissen’s passenger was injured in the crash. Prosecutors said a blood test showed Diermissen’s blood alcohol content was .18 percent, more than twice the legal limit.

The defendant on Oct. 17, 2012, was convicted of felony DUI causing injury. He was sentenced to serve felony probation and 180 days in jail.

Along with with his latest DUI conviction last week, Diermissen admitted he violated probation by committing a new crime, according to prosecutors.

On Friday, Diermissen was being housed at the Deuel Vocational Institution prison facility in Tracy.

The case was prosecuted by Deputy District Attorney Anthony Colacito working under a grant funded by the state Office of Traffic Safety.
