Medical parole denied for Modesto man
A 49-year-old Modesto man has been denied parole and will remain incarcerated serving a sentence of 80 years to life in prison, the Stanislaus County District Attorney’s Office announced Thursday.
On June 16, 2009, Russell Miles was convicted of burglary and three counts of felony assault with enhancements for using a knife. He had three previous felony convictions considered “strike” offenses and was sentenced to 80 years to life in prison.
Miles on Dec. 18 was seeking parole for health reasons, which would have moved him from the Stockton prison hospital to a private medical facility.
Deputy District Attorney Brad Nix appeared at the hearing and argued for continued confinement based on the risk to the public if Miles was granted parole.
The parole board determined that Miles’ two recent disciplinary actions in prison and his criminal history made him an unreasonable risk to the safety of others and denied his application for medical parole.
