Woman dies after truck hits her west of Modesto

A 23-year-old Modesto woman died Wednesday after she got out of her car along Maze Boulevard during an argument with her mother and a truck hit her.

Ermy Jan Semberino was declared dead at the scene. Stanislaus County coroner’s officials released her name Thursday morning.

According to the California Highway Patrol, Semberino was driving a red Nissan west on Maze/Highway 132 at Gates Road west of Modesto at 7p.m. She got into an argument with her mother, a passenger in the car.

Semberino made a U-turn, stopped her car on the right shoulder of eastbound Highway 132, got out and started walking in the eastbound lane. She was wearing dark clothing, the CHP said.

At the same time, David Abundiz Rivas, 52, was driving a 2012 Freightliner tanker east on 132. He saw the Nissan parked on the side of the road with its hazard lights on and moved left, partially into the westbound lane, to avoid it.

As Rivas moved back into the eastbound lane, he saw the woman walking on the road but could not avoid hitting her.

It did not appear alcohol, speed or drugs were a factor in the incident, the CHP said.
