A possible resolution for the unfair lawsuits being filed under the Americans with Disabilities Act against unsuspecting business owners would be to implement the same requirement that is now in place for medical malpractice lawsuits, that being that notice must be given to the medical provider who is going to be sued 90 days prior to the lawsuit being pursued. If the business owners in the ADA lawsuits being filed were given 90 days’ notice that they are in violation of ADA requirements and were going to be sued if the issue(s) were not resolved, then the business owners would have time to resolve the issues. This would equal fairness to both the business owners as well as the disabled individuals entitled to ADA accommodations.
