An inappropriate relationship between a Pitman High School math teacher and one of his students took place on the Turlock campus and in the 17-year-old's home, according to a criminal complaint the Stanislaus County district attorney's office filed Thursday.
Meanwhile, a prosecutor is evaluating a case involving a Turlock police officer who is accused of having a relationship with the same teen girl. The allegations came to light when the girl's mother learned about the relationships and demanded an investigation.
The men did not know each other, and their alleged relationships did not overlap, so the cases will be handled separately in Stanislaus County Superior Court.
"There are no charges of conspiracy or acting in concert," Deputy District Attorney Annette Rees said.
Math teacher Carl Troy Kubicek, 35, of Turlock has been charged with five felonies and one misdemeanor.
Four of the felony charges allege unlawful sexual intercourse with the 17-year-old, who is referred to as Jane Doe in legal papers.
One liaison allegedly took place Feb. 6 in Jane Doe's home, two days before the men were arrested. The others took place in two other homes and in a classroom at the Turlock school, from Sept. 1 to Feb. 5, according to the complaint.
Another felony charge alleges oral copulation with a person under 18, in a classroom, in the period from Sept. 1 to Feb. 5.
The misdemeanor charge, exploitation of a minor, suggests that the teacher took inappropriate photos of the student.
Kubicek was released on $20,000 bail after one night in jail. The Bee was unable to reach him for comment. He has worked for the Turlock Unified School District since July 2000 and also was an assistant football coach at Pitman High School. He was placed on leave when the allegations came to light.
The high school referred calls about the charges to the district office, where officials declined to comment.
A three-year veteran of the Turlock police also is suspected of having an inappropriate relationship with the 17-year-old.
Officer Jorge Fernando Cruz, 31, of Turlock was arrested on suspicion of rape, sodomy with a minor, unlawful sexual intercourse with a minor and oral copulation with a minor. He posted $50,000 bail a few hours after he was booked at jail and also is on administrative leave.
When the men were arrested Feb. 8, Turlock Police Chief Gary Hampton said Kubicek and Cruz acknowledged inappropriate relationships with the teen.
The chief said the young woman met Cruz because she was involved with the police department's Explorer Program. He described the teen's rela- tionship with the officer as coerced, adding that the teen began a relationship with her math teacher later.
Prosecutor Rees said she is reviewing the case involving Cruz and likely will file charges in the next few days. The two men will have their first court appearances soon, but arraignment dates for Kubicek and Cruz were not available.
