The Merced Union High School District Teachers Association filed an unfair labor practice complaint Wednesday against Scott Scambray, the district superintendent, with the Public Employment Relations Board.
The complaint alleges that Scambray tried to bargain with individual teachers over e-mail instead of negotiating with the teachers union.
According to the complaint, Scambray sent an e-mail districtwide urging employees to take a pay cut to reduce the number of layoffs.
This is a violation of the Employees Relations Act, said Sheila Whitley, the Merced CTA president.

Teachers associations are the only group that can conduct employment agreements with school districts.
