Scott Peterson's attorney today appealed to the California Supreme Court in a long-shot attempt to have his client's fate decided by a new jury in a new city.

The same requests were denied Monday by trial court Judge Alfred Delucchi; a panel of three appellate justices on Tuesday refused to review the ruling.

Peterson, 32, was convicted of murdering his pregnant wife, Laci, and their unborn son, Conner, just before Christmas 2002. The jurors who handed down that verdict are expected to sentence him to death or life in prison at the conclusion of a penalty phase scheduled to begin Tuesday in Redwood City.

Peterson's attorney, Mark Geragos, contends that jurors were tainted by crowds cheering the Nov. 12 verdict outside the courthouse.
