12:34 p.m.: Scott Peterson's attorney, still hoping for a new jury in a new city to decide his client's ultimate fate, this morning appealed Monday's denial of both requests.

Los Angeles lawyer Mark Geragos failed Monday to persuade the trial judge that jurors in Redwood City have been tainted by news coverage of the Nov. 12 guilty verdict for the Modesto man. Geragos this morning filed a writ with the First Appellate District in San Francisco, asking that Monday's decisions be overturned. He said if he loses there he will appeal to the California Supreme Court.

Legal analysts say the appeals have little chance of succeeding.

Decisions from the higher courts are expected before Peterson's penalty phase convenes Tuesday. That's when the same jurors who declared him guilty of murdering his pregnant wife and unborn son will hand down a sentence of life in prison or death.
