An Alameda County judge said Thursday that he will decide Feb. 24 whether to allow 14 new counts in the felony theft case against Tony Daniloo, the former head of Modesto-based mortgage firm DreamLife Financial.

Daniloo and his wife, Nansi, lauded only months ago for pledging millions to Emanuel Medical Center and California State University, Stanislaus, both in Turlock, already face 41 counts of grand theft and elder abuse for allegedly swindling Bay Area homeowners and title companies out of at least $1.3 million through real estate deals.

The new charges would bring to three the number of elderly victims allegedly duped out of money and property by Daniloo, who worked as a mortgage broker in the Bay Area before moving to Turlock in 2002.

The charges would add 10 years to the maximum sentence of 30 years Daniloo could receive if convicted.

The new charges would not affect the case against Nansi Masihi Daniloo, who is facing a maximum of seven years in prison as an alleged accomplice.

The Daniloos, who have not entered formal pleas, made a brief court appearance Thursday, but Judge Alfred Delucchi delayed a decision on the proposed new charges.

Prosecutors also expect Delucchi will set a date for the Dan-iloos to enter pleas at the next hearing.

Meanwhile, Tony Daniloo, 30, remains in Santa Rita Jail in lieu of $800,000 bail. Nansi Daniloo, 29, is free on $100,000 bail.

A federal investigation into DreamLife, which closed in December, is ongoing.
