Modesto couple in jail after fight with neighbors

A Modesto man and his girlfriend are in jail after authorities say they fought with a neighbor and shot the ground near him Saturday.

The fight started about 4:20 p.m. in the 400 block of Corson Avenue in central Modesto, said Modesto police spokeswoman Heather Graves.

The 37-year-old victim and his brother-in-law went to the home of his neighbors, David Virgen, 33, and Jamie Haflick, 31, regarding Virgen displaying a shotgun outside when children were present.

A verbal argument ensued, which authorities said escalated when Virgen punched the victim in the face. As they continued to fight, Haflick struck the victim in the back with a shotgun barrel, Graves said.

The victim told police that Virgen then turned on a stun gun. The electrical surge didn’t touch the victim, but scared him and his brother-in-law enough for them to leave, Graves said.

As they were walking away from the home, Graves said, Virgen fired his shotgun at the ground. One of the pellets ricocheted off the ground and hit the victim in the leg.

Officers arrested Virgen on suspicion of attempted murder, being a felon in possession of a firearm and ammunition, committing a crime while on bail and possession of a short-barrel shotgun.

Haflick was arrested on suspicion of assault with a deadly weapon.
