A judge has scheduled a preliminary hearing to start April 15 for the third defendant accused of murder in a 2009 Modesto shooting of a 10-year-old boy and a man killed in what authorities have called gang retaliation.
Joe Luis Ramirez, 33, was already in custody charged with other crimes in June when he was arrested in connection with the double-homicide.
Authorities say Ramirez, Aaron Aguilera and Randy Sifuentez are responsible for the deaths of Epifanio Ramirez Jr., 10, and Jason Cyphers, 29, in the 100 block of Santa Barbara Avenue in Modesto’s La Loma neighborhood.
Joe Luis Ramirez has no relation to the boy, who was not the intended target. The boy was killed by a stray bullet that went through a wall and hit his head.
Aguilera and Sifuentez are scheduled to return to court Tuesday, so the judge can reschedule their trial. The three defendants remain in custody.
At the conclusion of Ramirez’s hearing, the judge will determine whether there is enough evidence for his case to proceed to trial.
