Hearing set in former Modesto police sergeant's sex abuse case

— A judge on Tuesday scheduled a preliminary hearing for a former Modesto police sergeant accused of having sex with an underage female family member.

Robert Hodges, 40, also is charged with failing to comply with a court order not to contact the victim or her immediate family.

At the conclusion of the hearing, the judge will determine whether there is enough evidence to proceed to a trial. The charges involve one alleged victim, listed as Jane Doe in a criminal complaint, who was 15 when the sexual abuse is alleged to have started.

Authorities say the crimes occurred between July 2009 and May 2010. Hodges was a 15-year veteran of the department and was working patrol when he was arrested Oct. 22, but police have said the crimes aren't alleged to have taken place while on duty.

He no longer works for the department and remains free on $115,000 bail.
