Keep drunks off the road in California

As I recall, it is illegal to be in a motor vehicle while intoxicated. If so, why must a chosen one need to drive a vehicle containing a drunk?

Also a barkeeper was made responsible to keep all irresponsible drinkers inside the building. So why do we have so many crashes in the early morning hours? And doesn't the one who allowed this person to proceed out into the public area bear some responsibility for this? California lawmakers need to look into this!
